MADISON, Wis. — The man accused of attacking an elderly man in the parking lot of a Madison Culver’s last month was charged Monday.
Samuel R. Turner, 58, is charged with physical abuse on an elder person intentionally causing bodily harm and misdemeanor battery. Madison police arrested Turner last week.

A criminal complaint filed in Dane County Circuit Court on Monday alleges Turner punched a 78-year-old man in the face, causing the man to bleed. The man went to the hospital for medical attention following the alleged attack.
According to the complaint, the man was trying to turn into the parking lot of Culver’s in the 2100 block of West Beltline Highway at around 10:10 p.m. on August 28 when he saw Turner standing in the road and a vehicle blocking the path into the parking lot.
The man honked his horn and yelled at Turner to get out of the road and the vehicle moved. Once the man parked, Turner allegedly approached him while yelling obscenities and profanities. Turner then allegedly punched the man in the left side of the head.
The man said he fell down after the punch and allegedly saw Turner getting ready to throw another punch, but the man said Turner ran away because multiple people were standing outside the Culver’s and watching him.
Police reviewed security camera footage from the Culver’s, which allegedly shows Turner pointing aggressively at the victim before punching him in the face. Turner is then allegedly seen throwing a second punch which hit the victim in the head. Turner then allegedly gripped the man by the waist and punched him in the face from behind before pushing him into his own van. As the man was falling to the ground, Turner allegedly threw another punch, which did not connect.
On September 13, police asked the public for help finding Turner. On September 15, he was identified by an anonymous tipster at the Dutch Mill Park and Ride. Speaking to police, Turner reportedly said he did not recall getting into a fight at Culver’s.
Turner was traveling with a man identified as RJ. RJ had a duffel bag, which he said contained his and Turner’s personal items. Police searched the bag and allegedly found a stained t-shirt that matched the description of the shirt Turner was wearing on the night of the fight. Turner reportedly said the shirt belonged to him.
Online court records show that at an initial appearance Monday the court entered not guilty pleas to any misdemeanor counts. Turner’s signature bond was set a $500 per case. As a condition of his bond, he is not allowed to have any contact with the victim and is not allowed to go to the Culver’s in the 2100 block of West Beltline Highway.
